5 Questions to Ask Your Personal Injury Attorney
October 23, 2017 • Personal Injury
Hiring a personal injury attorney can be a difficult decision. You want to work with someone with whom you feel you can trust. And it is important to work with someone who will listen to your concerns, be available to answer your questions, and who will zealously advocate on your behalf.
As you are making the decision of who to hire to represent you, the following are 5 questions to ask a personal injury attorney.
- What areas of law do you specialize in?
Personal injury is a fairly broad area of law. Many personal injury attorneys specialize in certain types of cases or specific types of injuries. Ask the attorney you interview to discuss previous cases he or she has handled that are similar to yours, and what were the outcomes of those cases. This should give you a good feel for the attorney’s experience and how they will be able to handle your specific case.
We specialize in serious injuries. The majority of our clients come to us because they have suffered tragic, horrendous harms and losses because of someone else’s wrongful conduct. - Do you have time to take my case?
Always ask an attorney you’re considering hiring what their current case load is and if they have time for your case. Personal injury cases have deadlines that must be adhered to. You do not want your case lost in the shuffle, or put on the back-burner, because the attorney you select is too busy.
- How much do you charge to take personal injury cases?
Many personal injury attorneys do not charge clients until there is a settlement or a verdict after trial. It is not uncommon for individuals to not have the funds necessary to litigate a personal injury case. Personal injury attorneys are often willing to dedicate their time and funds to cases they believe in without a guarantee of repayment for their services.
Matthew G. Miller, PC, LLO covers all costs and fees upfront. Case costs and attorney fees are paid after the conclusion of your case, from the settlement or jury award. If you do not make a recovery in your case, you pay us nothing. We invite you to read more here.
- What is your trial experience?
This question is really important. There are a number of personal injury attorneys who do not often take cases to trial, or in some cases, have not seen the inside of a court room in a long time. It is not in your best interest to hire an attorney who is not known for taking cases all the way to trial.
While many cases are settled prior to trial, or even prior to a lawsuit ever being filed, it is important to hire an attorney who is ready and able to go the distance to make sure you get the fair and just compensation for your injuries that you deserve.

The attorneys of Matthew G. Miller, PC, LLO are seasoned jury trial lawyers. We are known for trying cases. This means we are equipped to get you the best possible outcome in your case. Many insurance companies decide how much someone will recover based on whether or not their lawyer actually picks juries and tries cases to a verdict. Insurance companies know us as attorneys who routinely try cases to verdict.
- How often do you take cases to trial?
Our practice has proved that about 65% of all cases we handle are resolved by settlement without ever filing a lawsuit.
If we do file a lawsuit, understand that only about 10 percent of all cases filed go all the way through trial. In 2016, the Nebraska Federal Court reported 1,662 filings for the year. Of these, 230 were civil cases. There were 22 cases tried that same year. So, only about 10% of all cases filed, ever go to trial. This is our experience, as well.
