Talking to your insurance company after an auto accident

When you are injured in an auto accident, you do have a responsibility to notify your insurance company of a potential claim. Ideally, we advise clients to hire an attorney as soon as possible so that we can handle this for you. But if you don’t have an attorney yet, you should notify your insurance company as soon as possible.

When you do speak with them, you should refrain from discussing your medical treatment, how you are feeling, and who you think was at fault in the accident and why. These are all issues that your attorney can properly handle on your behalf.

Many clients make the early mistake of thinking that their insurance company is looking out for their best interests, and they become too friendly on the phone with an insurance adjuster.

Remember that the insurance company is looking out for their own financial interests and will do so by denying claims, or minimizing claims. Even when they are your own insurance company, you could potentially have to file a claim with them for underinsured or uninsured motorist coverage. This is why hiring an attorney at the outset of your case can protect your future rights and make sure the insurance company does not take advantage of you.
